BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby abandoned Blackwell Street located northwest from Engel Avenue, between Mackey Avenue and Dudley Road, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Part of Blackwell Street, a 40 foot wide right-of-way. To find the true point of beginning of said part of street, start on the northwest line of Engel Avenue 440 feet southwest of the intersection of the northwest line of Engel Avenue with the southwest line of Mackey Avenue, said point also being the intersection of the northwest line of Engel Avenue with the northeast line of Blackwell Street, thence northwest 5 feet with the northeast line of Blackwell Street to the true point of beginning, thence southwest 40 feet parallel to Engel Avenue to the southwest line of Blackwell Street, thence northwest with said line 465 feet to the southeast line of Mackey Avenue, thence northeast 40 feet with Mackey Avenue to the northeast line of Blackwell Street, thence southeast 465 feet with the northeast line of Blackwell Street to the true point of beginning. 0C Said part of street separates lot 117 and part of lot 108 from lot 116 and part of lot 109, Engelton Heights, as shown by plat of record in plat book 15, page 8, ROHC. Tax Map No. 171A-A-8, 9, 16 and 17. SECTION 2. BE IT FURTHER ORDAINED, That this abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
